First you need to just think. When you are brainstorming don't evaluate or criticize your ideas or, if you are working in a team - other people's ideas. You rank your ideas later, but right now, just think and write. Write, write, write!!! No idea is too silly, because sometimes 'bad' ideas lead to great inventions. So have fun during brainstorming, because this step can be a lot of fun.


If you're having trouble brainstorming here are some things that you can do to get started. Look around the room, go into a different room, go outside, walk around looking at things in your house or garage, and try to find something you could make better. Kitchens, Bathrooms, Bedrooms, Garages and Neighborhoods are great places to get new ideas. Once you have your ideas, sit down and brainstorm some more.


Now its time to organize your ideas. You can organize your ideas any way you want. Pick the ideas from the list that really interest you. An idea or two that you think will be fun and exciting to invent. (And if you don't have an idea yet, that's ok - inventing takes time, just continue brainstorming until you find your invention.)



What Are Patents, Trademarks, Servicemarks, and Copyrights?

The difference between patents, copyrights, and trademarks can be confusing sometimes. Although there may be some similarities among these kinds of intellectual property (IP) protection, they are different and serve very different purposes.


What Is a Patent?

A patent for an invention is the grant of a property right to the inventor, issued by the Patent and Trademark Office. The term of a new patent is 20 years from the date on which the application for the patent was filed in the United States or, in special cases, from the date an earlier related application was filed, subject to the payment of maintenance fees. US patent grants are effective only within the US, US territories, and US possessions.

The right conferred by the patent grant is, in the language of the statute and of the grant itself, “the right to exclude others from making, using, offering for sale, or selling” the invention in the United States or “importing” the invention into the United States. What is granted is not the right to make, use, offer for sale, sell or import, but the right to exclude others from making, using, offering for sale, selling or importing the invention.



What Is a Trademark or Servicemark?

A trademark is a word, name, symbol or device which is used in trade with goods to indicate the source of the goods and to distinguish them from the goods of others. A servicemark is the same as a trademark except that it identifies and distinguishes the source of a service rather than a product. The terms "trademark" and "mark" are commonly used to refer to both trademarks and servicemarks.

Trademark rights may be used to prevent others from using a confusingly similar mark, but not to prevent others from making the same goods or from selling the same goods or services under a clearly different mark. Trademarks which are used in interstate or foreign commerce may be registered with the Patent and Trademark Office. The registration procedure for trademarks and general information concerning trademarks is described in a separate pamphlet entitled "Basic Facts about Trademarks".



What Is a Copyright?

Copyright is a form of protection provided to the authors of “original works of authorship” including literary, dramatic, musical, artistic, and certain other intellectual works, both published and unpublished. The 1976 Copyright Act generally gives the owner of copyright the exclusive right to reproduce the copyrighted work, to prepare derivative works, to distribute copies or phono records of the copyrighted work, to perform the copyrighted work publicly, or to display the copyrighted work publicly.
The copyright protects the form of expression rather than the subject matter of the writing. For example, a description of a machine could be copyrighted, but this would only prevent others from copying the description; it would not prevent others from writing a description of their own or from making and using the machine. Copyrights are registered by the Copyright Office of the Library of Congress.

Inventing is fun! You don't have to take our word for it, try it for a while, open up your mind and think, and you can find out for yourself just how much fun inventing can be.

There are many ways to invent, and best of all, there is no wrong way. Whatever works for you, is the right way for you. And remember, you never need permission to come up with a new idea or solve a problem. All you have to do is to think. Opportunities are all around you all of the time and you may not even realize it.

All inventions are solutions to problems. The problems can be old or new, but the solutions... now they should always be new. In fact, one of the fun parts about inventing is figuring out how many different solutions you can find to just one problem! Have you run across any problems recently? If you pay attention and look around your world, you'll see opportunities to solve problems everywhere.

Other inventions are pure imagination. Ideas that seem to come out of nowhere - things that no one has ever thought of before. Although these types of inventions aren't as common, they are just as fun and exciting as solving problems that you, your family, or your friends face everyday.

Listen for the word 'can't' and change it around to 'why not?' Count how many times you hear 'can't' in a day? (Except for the cant's from your mom or dad about eating ice cream for breakfast, or staying up late playing video games) Every can't is an opportunity to invent.

If the idea you are thinking of has already won awards such as Dr. Dads Eczema Lotion, it won't be eligible to patent again. Check the list of all inventions to make sure that your idea hasn't already been patented.
